Notwithstanding any measures which are adopted by the EU to prevent the risk of a violation of a fundamental right, in the event that the behaviour of a Member State seems to be acting contrary to the principles in the Charter of Fundamental rights Article 7 of the EU Treaty provides a mechanism for determining the existence of a clear risk of a breach or a serious and persistent breach of fundamental rights.
